Elder Law: Develops plans for possible incapacity or need for nursing home care, including preparation of Powers of Attorney, Health Care Proxies, Living Wills and Medicaid Trusts.
Assists clients seeking Medicaid eligibility for community or nursing home care. Represents clients at administrative hearings to challenge Medicaid denials. Advises clients of their home care options through Medicaid and Medicare.
Estate and Trust Administration: Assists Executors, Trustees and Administrators with all aspects of the administration of Estates and Trusts. Services include probate of Will, marshaling of assets, preparation of estate tax returns, sale and distribution of assets, preparation and filing of accountings and discharge of fiduciaries.
Advises trustees of Medicaid and Supplemental Security Income rules in the administration of a Supplemental Needs Trust.
Estate Planning: Develops Estate Plans for individuals and prepares documents, including Wills, Revocable and Irrevocable Trusts, Supplemental Needs Trusts, Life Insurance Trusts, and Charitable Trusts.
Guardianships: Assists with applications for appointment of Guardians for the incapacitated and developmentally disabled under Article 81 of the Mental Hygiene Law and Article 17A of the Surrogate's Court Procedure Act. Advises Guardians with all aspects of the management of guardianship estates.
Noelle joined McCabe & Mack LLP as an associate in 2007. Prior to joining McCabe & Mack, Noelle had a fellowship with Albany Law School's Health Law Clinic where she assisted individuals and families affected by serious chronic illnesses. Noelle and her husband Keith, a corporate attorney, reside in Rhinebeck.
