Creating or Updating a Will
Poughkeepsie Estate Planning Attorneys
A will need not be expensive or complicated. But it is important that it be thorough and thoughtful. The only thing worse than a poorly drafted will is no will at all.
If the time has come to put your wishes in writing, the estate planning group of McCabe & Mack LLP is ready to help. We can draft a will if you do not have one or revise your previous will to reflect a change in circumstances. One of our attorneys will sit down with you to discuss the pertinent scenarios so that all your bases are covered and your wishes are clearly expressed and honored.
We provide estate planning and elder law services to clients in Dutchess County and throughout the Hudson Valley.
Why Do I Need a Last Will and Testament?
In the absence of a will, the state of New York will dictate what happens to you and your estate. If you die, your assets may be divided in a way you didn't intend or subjected to taxes, creditor claims and probate delays. If you are incapacitated, a judge may make decisions about your care and your wealth.
We provide a set of documents that preserve your wishes and protect your interests:
- A will declaring your heirs and how your estate should be distributed
- Power of attorney over your property, finances and business affairs
- Health care proxy for medical decisions in your stead
- A directive to physicians (living will) regarding resuscitation, life support and end-of-life care
When Should I Revise My Will?
You should make a new will or update your will after a major life event. This could be the death of a spouse or child; the birth or adoption of a new heir; a divorce; or the acquisition of a house, business or other major asset. If your documents are not up to date, the court will have to follow your existing will, which could lead to family conflicts or even litigation.
