“Under Governor Cuomo’s recent Executive Orders modifying the Surrogate’s Court Procedure Act, a parent, legal guardian, legal custodian, or primary caretaker who works or volunteers in a health care facility or who reasonably believes they may otherwise be exposed to COVID-19 can now designate a temporary standby guardian to act in their place on behalf of a minor child for a period of 60 days, or longer if extended by a court order,” explains Rebecca Blahut, a partner with McCabe & Mack LLP who concentrates in guardianships and estate planning. “This document provides peace of mind and important legal protections for children and family members of solely responsible parents and caretakers who are healthcare workers, first responders, grocery store workers, and other essential employees whose jobs may expose them to COVID-19.”
